PRIVACY POLICY

SUMMARY. We collect the business contact, project and shipment information you give us, and limited technical information from your visits, to answer inquiries, quote and perform logistics services, and run our business. We share it with the carriers, contractors and other service providers needed to move your cargo, with vendors that help us operate, and with authorities where the law requires. We do not sell personal information, and we do not share it for cross-context behavioral advertising. You can ask to access, correct or delete your information by emailing Sales@ShipLGX.com. 1. WHO WE ARE AND WHAT THIS POLICY COVERS

LGX Freight Solutions, Inc. (“LGX,” “we,” “us” or “our”) is a logistics company based in Humble, Texas, providing project logistics, heavy-haul, freight forwarding and domestic freight services. This Privacy Policy explains how we collect, use, disclose and protect personal information when you visit www.shiplgx.com or any other website or online service we operate that links to this Policy (together, the “Site”), when you request a quotation or use our services, and when you otherwise communicate or do business with us.

We provide our services to businesses. Most of the personal information we handle is business contact information about people who work for our customers, carriers, vendors and other business partners. This Policy does not apply to information we process about our own employees in that capacity, or to the practices of third parties, including the carriers and other service providers we engage, which have their own privacy policies.

The services themselves are governed by our Estimate Terms & Conditions and the other terms that apply to them. This Policy governs personal information.

2. INFORMATION WE COLLECT

Information you give us

• Contact and identity details. Name, company, job title, email address, phone number, mailing address, country or region and preferred language.
• Project and shipment details. Cargo descriptions, dimensions and weights, origin and destination sites, schedules, site access notes, and documents you upload or send us, such as drawings, packing lists and commercial invoices. These may include the names and contact details of other people, such as site contacts and consignees. If you give us information about another person, you confirm that you are authorized to do so.
• Transaction and account details. Quotations, bookings, bills of lading, delivery receipts, invoices and payment records, and credit application information such as trade and bank references and tax identification numbers.
• Compliance information. Information needed to arrange customs clearance, export filings and permits and to screen transactions against sanctions and restricted-party lists, such as importer or exporter identification numbers and the names of the parties to a transaction.
• Carrier and vendor details. For carriers and service providers we work with: operating authority numbers (such as MC and USDOT numbers), insurance certificates, contact details, driver and equipment details for a shipment, and payment and tax information.
• Communications. The content of your emails, text messages, calls, form submissions and other correspondence with us.

Information collected automatically

When you visit the Site, our servers and hosting provider automatically record technical information such as your IP address, browser type, device type, operating system, referring page, the pages you visit and the date and time of your visit. When you submit a form, we record your IP address and browser details with the submission to help prevent spam and fraud. See Cookies and Similar Technologies (Section 5).

Information from other sources

• Our customers and business partners, for example when a customer names you as a site contact or consignee.
• Carriers, contractors and other service providers, for example tracking, delivery and proof-of-delivery information.
• Public and commercial sources, such as government carrier registries, sanctions and restricted-party lists, credit reporting agencies and business directories.

Sensitive information

We do not ask for sensitive personal information through the Site. Please do not submit Social Security numbers, driver’s license numbers, financial account numbers, health information or similar information through our website forms. If a transaction requires such information, we will tell you how to provide it securely.

3. HOW WE USE INFORMATION

We use personal information to:

• Respond to inquiries and prepare quotations, including assessing the equipment, routing, permits and scheduling a move requires.
• Arrange and perform services: booking carriers and contractors, planning lifts, storing and packing cargo, preparing documents, tracking shipments and communicating about them.
• Manage customer, carrier and vendor relationships, including credit review, invoicing, collections and payments.
• Comply with legal obligations, including transportation, customs, export control, sanctions, tax and recordkeeping requirements, and respond to lawful requests from public authorities.
• Protect our business, customers and the Site, including preventing fraud, spam and misuse, securing our systems, and establishing, exercising or defending legal claims and enforcing our terms.
• Operate, maintain and improve the Site and our services, including understanding how the Site is used.
• Send business contacts information about our services, projects and industry developments, where the law permits. You can opt out at any time (Section 11).
• Carry out any other purpose we describe when we collect the information, or that you consent to.

We may de-identify or aggregate information so that it no longer identifies any individual, and use that information for any lawful purpose. We do not use personal information for profiling that produces legal or similarly significant effects, or to make decisions based solely on automated processing.

4. HOW WE SHARE INFORMATION

We do not sell personal information. We share it only as follows:

• Service providers that perform the services you request. Motor, rail, ocean and air carriers, drayage providers, crane and rigging contractors, warehouses and terminals, packers, customs brokers, forwarding agents in other countries, insurers and permit services. They receive what they need to perform their part of the work, such as shipment details and the names and phone numbers of site contacts.
• Vendors that support our business. Providers of website hosting, email and communications, document storage, accounting, payment processing, and IT and security services, which process information on our behalf and are bound by confidentiality and security obligations.
• Government authorities. Customs, border, transportation and export control authorities in the United States and other countries, as required to move goods; and law enforcement agencies, courts and regulators where required by law or legal process, or where needed to protect the rights, property or safety of LGX, our customers or others.
• Professional advisors. Lawyers, accountants, auditors, insurers and collection agencies, where reasonably necessary.
• Business transfers. A buyer, successor or financing party in connection with a merger, acquisition, financing, reorganization or sale of all or part of our business, subject to this Policy.
• At your direction or with your consent.

We do not disclose personal information to third parties for their own direct marketing purposes.

5. COOKIES AND SIMILAR TECHNOLOGIES

Cookies are small files that a website places on your device. The Site may use cookies and similar technologies that are necessary for it to function and stay secure, such as those that remember a language choice or protect our forms from automated abuse.

We may also use analytics tools, such as Google Analytics, to understand how visitors use the Site. These tools use cookies to collect information such as the pages visited, time spent on them and approximate location derived from IP address, and we use the results in aggregate to improve the Site. You can opt out of Google Analytics with Google’s browser add-on at https://tools.google.com/dlpage/gaoptout.

We do not use advertising cookies, and we do not allow third parties to place advertising or cross-site tracking cookies on the Site.

You can block or delete cookies through your browser settings. Blocking necessary cookies may prevent parts of the Site, such as our forms, from working.

Some browsers send a “Do Not Track” or Global Privacy Control (GPC) signal. Because we do not sell personal information or share it for cross-context behavioral advertising, the Site does not change its behavior in response to these signals. Where applicable law requires, we treat a GPC signal as a request to opt out of the sale and sharing of personal information associated with that browser.

6. TEXT MESSAGES AND PHONE CALLS

If you give us a mobile phone number, we may call or text you about your inquiries, quotations and shipments. We send marketing text messages only with your prior express consent. Message and data rates may apply. You can opt out of text messages at any time by replying STOP or by telling us.

We do not sell, rent or share mobile phone numbers, or text messaging opt-in data and consent, with third parties or affiliates for their marketing or promotional purposes. The categories of recipients described in this Policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third party, except service providers that deliver our messages.

7. HOW LONG WE KEEP INFORMATION

We keep personal information for as long as needed for the purposes described in this Policy, including to perform services, maintain business records, resolve disputes and claims, and comply with legal obligations. Transportation, customs, export control, tax and accounting laws require us to keep many shipment, billing and compliance records for three to five years or longer. We generally keep inquiries that do not lead to business for no more than three years after our last contact, unless you ask us to delete them sooner. When personal information is no longer needed, we delete it or de-identify it.

8. HOW WE PROTECT INFORMATION

We use reasonable administrative, technical and physical safeguards designed to protect personal information, including encrypted connections to the Site, access controls, and confidentiality obligations for our personnel and vendors. No method of transmission or storage is completely secure, and we cannot guarantee the security of information you send us. Please take care when sending sensitive documents by email. If a security breach affects your personal information, we will notify you as required by law.

9. INTERNATIONAL TRANSFERS

We are based in the United States. Information you provide may be processed in the United States and in other countries where we, our service providers or our partners operate. International shipments require us to share information with carriers, agents, customs brokers and authorities in the countries of origin, transit and destination, whose data protection laws may differ from those where you live. Where the law of the country the information comes from requires a transfer safeguard, we use a safeguard that law recognizes, such as standard contractual clauses, or rely on an exception it allows, such as a transfer necessary to perform a contract with you or concluded in your interest.

10. INDIVIDUALS IN THE EEA, UK AND SWITZERLAND

If data protection law in the European Economic Area, the United Kingdom or Switzerland applies to our processing of your personal information, LGX Freight Solutions, Inc. is the controller, and we rely on the following legal bases: performing a contract with you, or taking steps at your request before entering into one; complying with our legal obligations; our legitimate interests in operating and promoting a logistics business, securing it, and managing our relationships with customers, carriers and vendors, where those interests are not overridden by your rights; and your consent, where we ask for it, which you may withdraw at any time without affecting earlier processing.

You have the right to access, rectify or erase your personal information, to restrict or object to our processing of it, including processing for direct marketing, and to data portability. You may also lodge a complaint with the data protection authority where you live or work. To exercise your rights, contact us as described in Section 11.

11. YOUR CHOICES AND RIGHTS

Choices

• Marketing emails. Use the unsubscribe link in any marketing email, or email us. We will still send messages about quotations, shipments and invoices.
• Text messages. Reply STOP, or tell us.
• Cookies. Use your browser settings (Section 5).

Privacy rights

Depending on where you live, including under the Texas Data Privacy and Security Act and the California Consumer Privacy Act, you may have the right to:

• Know whether we process your personal information and access it, including the categories of personal information, its sources, our purposes for using it and the categories of third parties to whom we disclose it.
• Obtain a copy of your personal information in a portable format.
• Correct inaccurate personal information.
• Delete personal information we hold about you.
• Opt out of the sale of personal information, its sharing for cross-context behavioral advertising, targeted advertising, and profiling in furtherance of decisions that produce legal or similarly significant effects. We do not engage in these activities.

These rights are subject to exceptions. For example, we may keep information we need to complete a transaction, comply with the law, or establish, exercise or defend legal claims. We will consider a request to access, correct or delete personal information from any individual, wherever they live, subject to the same exceptions.

How to make a request

Email Sales@ShipLGX.com with “Privacy Request” in the subject line, call 832-699-4540, or write to us at the address in Section 15. Tell us what you are asking for and how we can reach you. We will verify your identity before we act, usually by matching information you give us with information we already hold, and we may ask for more. An authorized agent may submit a request on your behalf with your signed permission; we may still ask you to verify your identity directly.

We will respond within 45 days of receiving your request. If we need more time, we will tell you why, and we may extend the response period once by up to 45 more days where the law allows. We will not discriminate against you for exercising your rights.

Appeals

If we decline to act on your request, in whole or in part, you may appeal by replying to our decision with “Privacy Appeal” in the subject line. We will respond to your appeal in writing within 60 days, explaining what we did and why. If your appeal is denied, you may contact your state attorney general. Texas residents may submit a complaint to the Texas Attorney General at https://www.texasattorneygeneral.gov/consumer-protection.

12. CATEGORIES OF PERSONAL INFORMATION

This table sets out the categories of personal information we collect, and have collected in the preceding 12 months, and the categories of recipients to whom we disclose them for business purposes. The sources and purposes are described in Sections 2 and 3, and retention in Section 7. We have not sold personal information or shared it for cross-context behavioral advertising in the preceding 12 months.

We use sensitive personal information only for the purposes the law permits without an opt-out, such as performing services, verifying identity, preventing fraud and complying with the law. We do not use it to infer characteristics about you.

13. CHILDREN

The Site and our services are intended for businesses and are not directed to children. We do not knowingly collect personal information from anyone under 16, and we do not sell or share the personal information of anyone under 16. If you believe a child has given us personal information, contact us and we will delete it.

14. LINKS AND CHANGES TO THIS POLICY

The Site may link to websites and services we do not control, such as carrier tracking pages. Their privacy practices are governed by their own policies.

We may update this Policy from time to time. We will post the updated Policy on this page with a new Last Updated date and, where changes are material, give additional notice as required by law. Changes apply from the date they are posted.
